Terms and Conditions of Shreeaksh Website
With the initiation of your affiliation with Shreeaksh as a partner of your web designer and/or web developer, it is considered that you support all the terms and conditions stated on https://shreeaksh.com.au/#.
The terms and conditions below are standards presented by the Shreeaksh Website and apply to all work and agreements that the company commits for all its clients. The employees of Shreeaksh adhere to these terms and conditions, as do the clients of Shreeaksh.
Payment & Deposit Terms
Clients must pay a 50% deposit upfront, 25% upon the first draft, and 25% upon completion as per the proposal laid by Shreeaksh. Payments may vary if agreed upon beforehand. Work may pause until full payment is made. No refunds after work begins.
Information Sharing Policy
As a client, you must deliver significant information like photos, logos, and content at the project’s beginning or end. Delays in providing this may stretch the target dates. If delays halt progress, we may invoice for work completed.
Project Timelines & Revision Policy
We’re pleased to offer you an opportunity to share your feedback on the work we have delivered. We’re also open to upgrading as long as we both agree on the initial proposal. However, we may limit the number of changes permitted for the website design. If modifications go beyond the initial proposal, we may charge an additional fee.
Our services allow a specific number of revisions after you’ve reviewed the work.
Managing Project Delays and Client Responsibilities
The finishing times presented in the proposal are estimates and rely on our teamwork with the client. We need feedback at various project stages to deliver a final product that meets expectations. Shreeaksh requires an assigned representative from the client for communication and feedback. The client is responsible for providing regular feedback to keep the process efficient.
Work Approval Process
Once we agree on the initial draft of the website, you can make changes. However, as stated in the “Payment & Deposit Terms,” refunds will not be provided. You must notify us in writing within 7 days of any changes or issues regarding the work. If no written feedback is received within 7 days, the work will be considered approved, and the remaining balance will be due.
Work Rejection Policy
If you reject any web design and/or development work within 7 days or do not endorse the reviewed work after an initial rejection, we will assess and make changes if reasonable. If we determine the rejection is unreasonable, we may consider the contract finished. In this case, the remaining balance will still be due.
Final Payments
After the 7-day review period, Shreeaksh will issue an invoice for the remaining balance as agreed in the quotation.
Intellectual Property Ownership
The client is responsible for providing licensed materials or obtaining necessary rights for using logos, images, content, and other project materials.
Shreeaksh is not liable for legal issues or claims related to the website’s content, and you agree to hold us harmless in such cases.
Website Ownership and Authority
Once the project is completed and all payments are made, Shreeaksh will transfer full ownership and authority of the website to the client.
Royalty
We may place our logo on your website. If you do not want our logo, you must inform us before the project starts, and additional royalty fees may apply.
Search Engine Optimization
We do not guarantee specific search engine rankings as part of our web design and development service. Basic SEO is included in website design, following best practices. If you opt for SEO services, they require a minimum six-month commitment with a one-month cancellation notice.
Liability for Future Losses
Shreeaksh is not responsible for any losses or damages due to project delays, regardless of the reason.
Limitations of Liability
To the maximum extent permitted by law, we exclude all terms, conditions, warranties, or representations related to our services except as stated in these terms and conditions. If any liability cannot be excluded, Shreeaksh’s responsibility will be limited to either replacing, repairing, or re-supplying the services or covering their cost.
Use of Subcontractors
We reserve the right to subcontract or outsource services as deemed necessary.
Confidentiality Agreement
Shreeaksh and its subcontractors agree not to disclose your private information to third parties.
Extra Expenditure
You agree to cover additional expenses for services excluded from the original proposal, including third-party software, web hosting, domain registrations, templates, and other costs.
Website Backup Policy
If we do not manage your website, you are responsible for backups. We are not liable for restoring lost data unless the loss was due to negligence by Shreeaksh or its employees.
Applicable Law
This contract is governed by Australian law. Both parties agree to the jurisdiction of Australian courts for any disputes.
E-Commerce
You are responsible for ensuring your e-commerce website complies with all applicable laws. You agree to hold Shreeaksh and its subcontractors harmless from any claims, penalties, fees, or damages related to your e-commerce operations.
